Please read this End User License Agreement ("Agreement") carefully before using Building Scheduler ("Software"). By installing, accessing, or using the Software, you agree to be bound by the terms of this Agreement. If you do not agree, do not use the Software.
Subject to the terms of this Agreement, the licensor grants you a limited, non-exclusive, non-transferable license to install and use the Software solely for your internal business operations related to construction project and building management.
You may not:
The Software and all copies thereof are proprietary to the licensor and title thereto remains with the licensor. All rights in the Software not specifically granted in this Agreement are reserved.
The Software may connect to third-party services including Dropbox, CompanyCam, QuickBooks Online, and Rentcast. Your use of those services is governed by their respective terms of service and privacy policies. The licensor is not responsible for the availability, accuracy, or conduct of any third-party service.
The Software stores data in a database that you are responsible for hosting and maintaining. You are solely responsible for backing up your data. The licensor is not liable for any data loss resulting from hardware failure, misconfiguration, or any other cause.
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE LICENSOR DOES NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE LICENSOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF THE LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any term. Upon termination, you must cease all use of the Software and destroy all copies in your possession.
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the licensor operates, without regard to conflict-of-law principles.
This Agreement constitutes the entire agreement between you and the licensor with respect to the Software and supersedes all prior or contemporaneous understandings regarding such subject matter.
